Protective order proceedings tend to be highly personal, emotional and sensitive for everyone involved. We are leaders in Indiana family law, and our highly experienced team of attorneys is here to guide you through these delicate legal matters  – whether you need assistance with obtaining a protective order or require defense against a protective order.

What Are Protective Orders?

In Indiana, protective orders are legal tools to help protect individuals from domestic or sexual violence. If you or your children are in danger of being harmed by someone you have been in a relationship with, you can apply for a protective order. These orders can prevent the person from contacting or coming near you, your home or your workplace. If the person violates the order, they could face arrest and criminal penalties.

Who Can File For A Protective Order?

You must be at least 18 years old to file for a protective order. If either the petitioner or the respondent is under 18, a parent must file the order on behalf of the minor. If you have already filed for dissolution, the protective order must be filed in the same court as that proceeding. Additionally, a relationship must exist between the parties, including current or former spouses, people who live together or those who are dating.

There are several details in the application that must be filled in properly. You need the respondent’s address, Social Security number and date of birth, if known. You must also provide a detailed account of the incidents that led to the need for protection. The petition must include the dates of birth of all individuals needing protection. A judge must approve the order, and there will be a hearing, if requested by the other side.

Duration Of Protective Orders

The duration of a protective order can vary. Typically, these orders can last up to two years. However, the court may extend or modify the order based on the circumstances. It is crucial to understand the specific terms and duration of your protective order, and our Carmel family law attorneys are here to help you with this process.

Has A Protective Order Been Filed Against You?

If you require defense of a protective order, our attorneys can launch into swift action to protect and defend your rights. As family law attorneys, we know that false allegations of domestic or sexual violence can occur in an effort to leverage results for the other party in divorce proceedings. There are two sides to every story, and we will listen to your side, evaluate your options and seek to prevent, lift or remove the protective order, if we believe you have a valid defense.
